Cains has extensive insolvency and corporate reconstruction experience, with particular experience of insolvency in the financial services industry. Our advocates have acted for liquidators in numerous high profile liquidation matters, requiring extensive work on fraud, inter-mingling of funds and the tracing and recovery of assets. We have acted in several major cross-border insolvencies, including acting for the Isle of Man liquidators of BCCI and Barlow Clowes, and more recently Kaupthing Singer & Friedlander (Isle of Man) Limited (in liquidation).
We act for trustees in bankruptcy, bankrupts’ creditors and those with other interests in individual insolvencies. Much of this type of work also involves cross-border and multi-jurisdictional issues.
Our advocates have dealt with a number of substantial schemes of arrangement, debt restructuring and corporate rescues. Recent cases include advising on a scheme of arrangement for the merger of two banks and advising on the restructuring of a company’s capital in excess of US$1 billion.
