Experience:
Seth is a director of Cains and heads the commercial litigation department. His main
areas of practice involve commercial litigation with particular focus on trust disputes,
asset tracing & fraud recovery, judicial review and regulatory issues. He advises numerous
liquidators on Manx insolvency law and acted on behalf of the Manx liquidator of BCCI in
relation to a number of trust issues. He has considerable expertise in relation to
Petitions of Doleance (the Manx equivalent to judicial review) and he has appeared in
many of the leading commercial cases at the Manx Bar.
In addition, Seth advises the Isle of Man Financial Supervision Commission on enforcement
matters in relation to investment business and banking issues and he acted for the US
Securities and Exchange Commission in the recent case of Re Poyiadjis in the Isle of Man High
Court.
Seth is a member of the Council of the Isle of Man Law Society, the Association of Contentious
Trust and Probate Specialists, the International Bar Association, the Human Rights Institute and
the Isle of Man Government Insolvency Review Working Party. Seth is also the Isle of Man contributor
to the Insolvency Intelligence Journal, a conference speaker on asset tracing in the Isle of Man,
and the author of various articles relating to Manx law. He also wrote the chapter on remedies in the
Isle of Man in "International Commercial Fraud" (General Editors: Goldspink and Cole) published by
Sweet & Maxwell.
