In administering an estate, the process of collecting in the assets and paying the liabilities, dealing with the Courts and handling other matters arising out of the administration can be complex. We provide personal representatives and family members with sensitive and efficient support at a time of stress. Cains are often appointed as executors under a will, but are equally able to offer legal advice or assistance to personal representatives on any aspect of estate administration.

We are frequently involved in the administration of international estates holding assets in several jurisdictions. Again, we seek to combine technical expertise with a sympathetic approach to sensitive issues.

Together with our Litigation departments, we offer advice and assistance in contentious trust and probate matters. Whatever the cause, family disputes are usually painful and can be expensive. Keeping costs down and reaching a speedy resolution are always priorities. This might involve resolving a dispute at an early stage in correspondence or, alternatively, might lead to launching a full-scale probate action. It can be acrimonious work, but, by providing balanced advice, we would always try to find an acceptable solution. Cains also advises individuals on the application of inheritance legislation, which may enable persons not otherwise entitled under a will or intestacy to make a claim against an estate.
