Cains' commercial litigation department has two qualified mediators (Robert Colquitt and Giles Hill) who are both accredited by the ADR Group; ADR Group is one of the leading dispute resolution companies in the United Kingdom.
Our experience over time in dealing with a variety of commercial litigation cases suggests that, whilst there will always be a number of cases that will most likely only be concluded by a full hearing before the court, there are also a number of other cases that might settle at an early stage, if the opportunity is made available. This is where mediation can assist. Mediation is essentially a confidential and without prejudice method of resolving disputes, where a trained mediator helps the parties in trying to reach an acceptable solution to the dispute. There are potentially significant savings of time and costs to be made by parties involved in any dispute if that dispute can be resolved through mediation at an early stage of litigation, or even before legal proceedings have been commenced. Mediation seeks to provide a framework within which, hopefully, the parties can resolve their differences quickly and economically.
Both Robert Colquitt and Giles Hill offer their services in either representing commercial parties at a mediation or to act as mediators for commercial parties who are in dispute.
