Judicial Review

Redress by Petition of Doleance in the Isle of Man is broadly equivalent in effect, if not procedure, to judicial review in the United Kingdom. It enables the courts to regulate the decision making processes of public bodies. Cains has built up a substantial public law practice and has been involved in several important Doleance cases in the Isle of Man in recent years. Cains' advocates have acted in challenges against government departments, local authorities, administrative bodies and tribunals on questions of both Manx and European law.

Human rights legislation in a commercial context will have an increasing impact on the way business is conducted and disputes resolved. Cains' commercial litigators are well versed in the likely impact of human rights legislation on the obligations of public bodies.

We are always willing to discuss the full options available to clients who wish to respond to any action taken by a public body.
