Pensions & Employee Benefits

Cains is the Island's only law firm with a City trained lawyer specialising in pension and employee benefits. The Cains' pensions group advises corporate clients and pension scheme trustees alike and has advised on a wide range of contentious and non-contentious pension issues including: scheme design; establishment, tax approval and IPA authorisation; product development; scheme mergers and winding up; scheme deficit and surplus; corporate sale, acquisition, restructuring and insolvency; executive severance and advice relating to professional advisers and investment management. The group also has experience of independent trustee work and can provide independent corporate trustee services.

The Retirement Benefit Schemes Act 2000, which was brought into force on 1 January 2001, established an overarching regulatory framework for domestic and international pension schemes. The Act has achieved the Isle of Man Government's intention of combining good governance with a system of effective but cost efficient regulation. Accordingly, the Act provides a foundation for multi-national business to rationalise its pension provision under one regulatory regime and, if desired, one set of trustees, advisers and administrators. Cains' pensions group can advise on how businesses should most effectively structure their pension arrangements under the Act.

Cains has unrivalled experience in providing legal advice on employee benefits on the Island. Cains advises various banks and multinational employers with regard to their respective share option plans. Our lawyers are always happy to take time to discuss any issues clients may have before proceeding with formal instructions.
