Cains Announces Commercial Mediation Service
Cains announces its ability to offer a commercial mediation service, in addition to its current commercial litigation expertise.
Two of Cains' Litigation Departmental Directors, Robert Colquitt and Giles Hill, recently became ADR Group Accredited Mediators; ADR Group is one of the leading dispute resolution companies in the United Kingdom.
When asked why the new service is being offered Robert Colquitt said: "Experience over time in dealing with a variety of commercial litigation cases suggests that, whilst there will always be a number of matters that will most likely only be concluded by the court, there are also a number of other cases that might settle at an early stage, if the opportunity is made available. This is where mediation can assist. Mediation is essentially a confidential and "without prejudice" method of resolving disputes, where a trained mediator helps the parties in trying to reach an acceptable solution to the dispute. There are potentially significant savings of time and costs to be made by parties involved in any dispute if that dispute can be resolved through mediation at an early stage of litigation, or even before legal proceedings have been commenced. Mediation seeks to provide a framework within which, hopefully, the parties can resolve their differences quickly and economically.
Also, it is worth noting that the Isle of Man Court Rules are in the process of being reviewed by the court and Tynwald and it is anticipated that mediation will become a more common and important aspect of litigation in the Isle of Man"
